Terms of Service

These terms govern your use of BotDesk (botdesk.studio) — AI chat widgets, dashboards, and related services. By creating an account or embedding the widget you agree to them.
The service
BotDesk lets businesses create an AI chatbot trained on their own content, embed it on their website, capture leads and conversations, and optionally hand chats to human team members. Features vary by plan as described on the pricing page.
Trials, billing & cancellation
- Paid plans start with a 7-day free trial; a card is required and billing begins on day 8 unless you cancel first.
- Subscriptions renew monthly until cancelled. You can cancel any time from the billing portal — access continues to the end of the paid period.
- Plan changes take effect immediately and are prorated by Stripe.
Your responsibilities
- Provide accurate business information — your chatbot answers with what you give it, and you're responsible for what it represents to your customers.
- Comply with the laws that apply to your business, including obtaining any consent needed from your website visitors for chat processing and for SMS/email follow-ups.
- Keep your sign-in credentials secure, and only add team members you authorize to read your customer conversations and leads.
- Don't use the service for anything unlawful, deceptive, or abusive — including spam, scraping other services, or attempting to access other customers' data.
AI-generated content
Chatbot responses are generated by AI and can be imperfect. BotDesk grounds answers in the content you provide, but you should review your bot's configuration and not rely on it for legal, medical, or financial advice to your customers.
Data processing
This section is our data processing agreement with you. It applies whenever we handle personal data belonging to your customers or site visitors, and it forms part of these terms.
- Roles. For personal data about your customers and visitors, you are the controller and BotDesk is the processor. You decide what your chatbot collects and why; we handle it on your behalf. For your own account data we act as controller, as described in the Privacy Policy.
- Instructions. We process that data only to provide the service, and only as instructed by you through your settings and these terms — never for our own advertising, profiling, or resale. We do not sell personal data. We do not use your customers' conversations to train AI models.
- Confidentiality. Anyone with access is bound by confidentiality obligations, and access is limited to those who need it to run or support the service.
- Security. We apply appropriate technical and organisational measures, including encryption in transit and at rest, additional application-level encryption of connected-store access tokens, role-based access, and encrypted backups.
- Sub-processors. We use the providers listed in the Privacy Policy, each under terms protecting personal data. We will announce new sub-processors to account holders by email before they start processing, giving you the opportunity to object.
- International transfers. Our providers may process data outside your country. Where required, transfers rely on Standard Contractual Clauses or another lawful transfer mechanism.
- Assistance. We will help you respond to requests from your customers to access, correct, export, or delete their data, and assist with security assessments and regulator enquiries relating to data we process for you.
- Breach notification. If we become aware of a personal data breach affecting your data, we will notify you without undue delay and within 72 hours, with what we know and what we are doing about it. Our incident response policy sets out how we handle this.
- Retention and deletion. Retention periods are set out in the Privacy Policy. On termination we delete the personal data we hold for you within the periods stated there, except where law requires us to keep it.
- Audit. On reasonable written request, and no more than once a year unless a regulator requires otherwise, we will provide the information reasonably necessary to demonstrate compliance with this section.
Availability & support
We aim for high availability but the service is provided "as is" without uptime guarantees. Support is available at hello@botdesk.studio.
Liability
To the maximum extent permitted by law, BotDesk's total liability for any claim is limited to the fees you paid us in the 12 months before the claim arose. We are not liable for indirect or consequential damages, or for the content of conversations between businesses and their visitors.
Termination
You can stop using the service and cancel at any time. We may suspend or terminate accounts that violate these terms or abuse the platform, with notice where practical.
Changes
We may update these terms; the date above reflects the latest revision. Material changes are announced to account holders by email, and continued use after a change means acceptance.
